The Parties and Background

The lex domicilii matrimonii rule, adopted in Frankel’s Estate (1950) and confirmed in Sperling, provides that the proprietary consequences of a marriage are governed by the law of the husband’s domicile at the time of marriage. The rule is fixed and admits no exceptions.

Although the Domicile Act 3 of 1992 abolished the wife’s dependent domicile, the lex domicilii matrimonii rule survived unchanged. It was confirmed, reluctantly, in LE v LA (2024).

The Rule Under Challenge

The lex domicilii matrimonii rule, adopted in Frankel’s Estate (1950) and confirmed in Sperling, provides that the proprietary consequences of a marriage are governed by the law of the husband’s domicile at the
time of marriage. The rule is fixed and admits no exceptions.

Although the Domicile Act 3 of 1992 abolished the wife’s dependent domicile, the lex domicilii matrimonii rule survived unchanged. It was confirmed, reluctantly, in LE v LA (2024).

The Minister’s Position

The Minister of Justice abided the declaration of invalidity but opposed the applicant’s proposed retrospective remedy. She proposed a two-year window for all existing marriages to opt into the new rule, with retrospectivity applying immediately to same-sex marriages only. The Court rejected this as irrational: it would perpetuate an unconstitutional regime for opposite-sex spouses while remedying it for same-sex spouses, a distinction with no defensible basis.

The Judgment

Acting Judge Golden found the rule unconstitutional on all three grounds. Differentiation on sex, gender and sexual orientation is presumed unfair under section 9(3), and no justification was advanced to rebut that presumption. The Court then developed the common law under section 172(1)(b) as the just and equitable remedy, applying the framework in Mighty Solutions CC v Engen Petroleum.

The Court drew on the 1978 Hague Convention on the Law Applicable to Matrimonial Property Regimes and EU Regulation 2016/1103, both gender-neutral instruments endorsing party agreement and a tiered default hierarchy.

The applicant, a Colombian-born woman educated in England, married the third respondent, a Zimbabwean citizen, in Hong Kong in 1997. The marriage broke down and the applicant instituted divorce proceedings in the Western Cape High Court in April 2023.

The central dispute was which country’s law governed the proprietary consequences of the marriage. The third respondent relied on the common law rule to contend that Zimbabwean law applied, being his alleged domicile at the time of marriage. The applicant contended for the law of England and Wales. That factual dispute was not resolved; what was resolved was whether the rule itself was constitutionally valid.

The applicant also brought the application in the public interest under section 38(d) of the Constitution.

The New Five-Step Rule

Retrospective Application

The new rule applies retrospectively to all existing marriages, subject to four carve-outs

Where spouses chose a governing law in an antenuptial contract: the new rule does not apply for two years, to allow amendment of the contract.

Where no law was chosen: the new rule applies unless it causes substantial prejudice.

Transactions already completed under the husband’s domicile rule are not disturbed.

Marriages dissolved by death or divorce before 23 June 2026 are excluded.

Costs

Both Ministers were ordered to pay costs jointly and severally on Scale C. The Court confirmed that the principle applicable to unconstitutional statutes applies equally to unconstitutional common law rules. The State’s thirty-year inaction, notwithstanding CEDAW ratification in 1995, the 1992 abolition of dependent domicile and repeated judicial acknowledgment of the problem, was the decisive factor.

Analysis and Implications for Conveyancers

The judgment in NP v Minister of Justice is the most significant development in South African matrimonial property law in a generation. For conveyancers it demands attention on two levels: understanding the new framework, and identifying which clients need immediate review.

Why This Matters for Property Practitioners

Every property transaction involving a married person who concluded an international marriage engages the applicable marital property regime. Under the old rule the answer was always the husband’s domicile at the time of marriage: a single, inflexible connecting factor. That fixed reference point no longer exists.

Its replacement is a hierarchy beginning with party agreement. Where no agreement was made, the practitioner must work through domicile, habitual residence, nationality and closest connection in sequence. This requires a factual investigation rather than a single-factor test.

THE FIXED REFERENCE POINT OF THE HUSBAND’S DOMICILE NO LONGER EXISTS. A FACTUAL INVESTIGATION NOW REPLACES A SINGLE-FACTOR TEST.

Four Client Categories Requiring Immediate Attention

Clients with foreign-law
antenuptial contracts.

Where spouses chose a governing legal system in their ANC, that choice stands for two years from 23 June 2026. Clients should be advised to review whether the original choice satisfies the substantial link requirement and, if not, to amend the ANC within the window period.

Clients in international marriages
without any choice of law.

The new rule applies immediately unless retrospective application causes substantial prejudice. Where the governing system changes as a result, the parties’ property rights in relation to future transactions are affected. Transactions already concluded are not disturbed.

Clients in pending
divorce proceedings.

The applicable marital property regime in pending divorces must be re-analysed under the five-step hierarchy. The old shortcut of identifying the husband’s domicile at the time of marriage is no longer available.

Non-resident buyers
of South African property.

Foreign buyers in international marriages are a significant portion of the Western Cape and Garden Route property markets. The question of which legal system governs the marriage affects capacity to purchase, the manner of registration and the consent required. Where the new hierarchy does not produce a clear answer from available documents, a specialist private international law opinion should be obtained before proceeding.

The Substantial Link Requirement

The Court modified the SALRC’s proposal, which would have permitted spouses to choose any legal system without restriction. The Court requires a substantial link between the chosen system and one or both spouses. A choice with no connecting factor to either party will not be valid. Conveyancers advising on ANCs for international couples must ensure that any choice of law is grounded in nationality, domicile, habitual residence or a similarly substantive connection.

What the Judgment Does Not Disturb

The judgment is confined to the lex domicilii matrimonii rule. It does not affect the Matrimonial Property Act 88 of 1984, which continues to govern South African domestic marriages. It does not reverse transactions already completed. It does not address the substantive content of the applicable system once identified. And it does not apply to marriages dissolved before 23 June 2026.

The Costs Principle

The Court confirmed that no principled distinction exists between a costs order arising from an unconstitutional statute and one arising from an unconstitutional common law rule. State inaction in the face of a known constitutional defect carries the same consequences in both cases. The SALRC process does not shield the Executive from its obligation to act.

International Alignment

The new South African framework mirrors the approach of the 1978 Hague Convention and EU Regulation 2016/1103: party agreement within connecting factors, followed by a tiered default hierarchy, all expressed in gender-neutral terms. Practitioners advising on transactions involving European counterparties will find the frameworks broadly compatible.

Legislative Reform Still
Required

The judgment resolves the immediate constitutional defect. It does not substitute for the statutory reform the SALRC has been developing under Discussion Paper 160 (Project 100E). Legislation would provide greater procedural certainty, particularly around the amendment of existing ANCs and the protection of third parties. Practitioners should anticipate legislative activity in this space in the medium term.

PRACTICAL STEPS

Review pending international marriage files.

Re-analyse the applicable regime under the five-step hierarchy for every matter involving an internationally married party.

Identify ANCs with foreign choice-of-law clauses.

Advise clients of the two-year window and check the substantial link requirement.

Update intake forms and precedents.

Capture domicile, habitual residence and nationality at the time of marriage
as standard information for all internationally married clients.

Coordinate with divorce litigators.

The applicable system in pending divorces must be
re-determined under the new rule.

Obtain specialist opinions where the hierarchy is inconclusive.

Do not proceed with registration where the governing system
cannot be clearly identified from available facts.
